Terms and Conditions...
Many of our customers are our friends, so rather than adding a
lot of restrictions in which some may look for loopholes, we choose
instead to list out some basic concepts that govern all transactions
between us. Our goal is a simpler trading environment
and a more positive and relaxed buying experience. The following
apply to all items and services offered on this site:
- All items are used items, unless specifically stated as otherwise,
and are sold "As-Is" and "Where-Is."
- Some items have images displayed
with them. These images are for illustrative purposes only,
and are not necessarily images of the actual item offered. If
the image displayed is an image of the item, your item will look
substantially like the image.
- Items listed as "New Pull" are parts removed from
a motorbike when it was new or almost new. These parts may have
been used for a very short period of time. For example, a "New
Pull"
final drive unit may have the mileage from the manufacturers
testing, dealer assembly and road testing, and transportation
to the modification center where the part was removed from the
vehicle. Thusly, even parts listed as "New Pull" are
technically used parts and are sold as such.
- Most of our items cannot be packaged in the same box as other
items due to their size, shape, and/or weight. For this reason,
our shopping cart lists a fixed shipping charge per item. If
you
order multiple
small items that we can package together, please email us before
sending your payment. We will be happy to combine items where
we can to save you the additional shipping expense and to save
us the additional packaging time and costs. We both win when
this works out!
- Items are normally shipped by ground services using a carrier
of our choosing; usually FedEx Ground or USPS. If you want your item shihpped
by other means, please ask before you place your order. We
will accomodate when possible. Any extra charges will be your
responsibility.
- Most shipping carriers tack on a fuel surcharge due to rising
energy costs. This is already built into our shipping charges.
- For your protection, all items are insured for
their purchase price. Insurance is included
in the cost of shipping.
- All items are sent "signature required"
so please make sure someone will be available to sign for the
package. You may also have the option to sign
the notice left by the carrier if you want them to leave the
package
at
your
door
or other location. Availability of this option may vary based
on circumstances determined by the carrier and election to give such release to carrier is done at your own risk. You agree that if any item is returned to us, charges oulined in items 12 - 14 (inclusive) appearing below will apply to you. To avoid this, please let us know if you will be unable to accept possession from the carrier so that special arrangements might be made to assist you. If you pay via PayPal or credit card, any special arrangements must confirm to any and all PayPal and/or credit card restrictions on delivery. You acknowledge that we will try to make accomodation for you as a courtesy, but we are not obligated to so if our doing so would put the delivery in violation of carrier, PayPal, credit/debit card, federal, state, or local law, ordinance, etc., and/or these conditions of sale.
- Some bulky items are very light in weight but are large in
size. Shipping companies charge higher prices for these items
using a scheme called dimensional weight. While ten pounds of
feathers weigh the same as ten pounds of lead, the feathers would
require a much larger package. NOt only weight, but also item
and packaging size are part of what determines the shipping cost.
This is already built into our shipping charges.
- Most shipping carriers add residential surcharges, dimensional surcharges, rural surcharges, surcharges for signature at time of delivery. These costs are already built into our shipping charges. NOTE: Return shipping charges, re-shipping charges, re-direction charges, and other non-standard charges are NOT included in our shipping rates and you agree to reimburse us IN FULL for any such charges incurred due to your action or inaction that causes such chaarges to be posted.
- Title to items purchased from us is transferred to the you, the buyer, at the moment we tender posession of the item(s) to the shipping carrier. You are responsible for filing any claims for lost or damaged item(s), but we will render all reasonable assistance to you in order to expedite this process. Since the product is yours at time of shipment, you agree not to refuse delivery of any package from us unless you have obtained authorization from us in advance.
- Since title to the goods passes to you upon deposit of the item(s) with the shipping carrier, you waive your right to file a dispute or claim with PayPal or your credit/debit card issuer for "non-delivery" provided the item(s) are placed in the care, custody, and control of the shipping carrier within thirty (30) days from the date of your payment for the item(s), unless written correspondence between us via email allows for a longer period of time for shipment. Our goal is to ship the same or next business day based on your order time, the item ordered, and any special instructions or agreement between us regarding your order. An example might be a delay due to travel, pre-ordered or special order parts, wait listed items, illness, or any other situation or circumstance that has been agreed to in writing via email(s) between us.
- Your failure or refusal to take physical posession from the shipping carrier does not change any of these terms and does not release you from any obligation incurred under these conditions of sale and you agree that if you fail or refuse to take physical posession of your property from the carrier you unconditionally accept the obligation to pay additional shipping charges for the return trip back to us and for us to re-ship your property back to you, regardless of how many times you fail to accept or refuse physical posession. The amount of shipping for each direction of travel shall be calculated as an amount equal to the original shipping and handling charges appearing on your order confirmation page when you initially placed said order.
- You agree that we shall have no obligation to re-ship your property to you unless you make restitution to us for any and all return and re-ship charges as stipulated above. You agree that unclaimed items may be disposed of in a manner selected at our sole discretion and without any compensation or consideration to you of any kind if you do not make restitution for these charges and claim or re-direct shiping within thirty (30) calendar days from the date you failed or refused to take physical possession of your property from the shipping carrier. Any such disposal shall not release you from any other obligations under this agreement, and you will still owe us return shipping charges and any other costs, fees, or any other type of expenses arising directly or indirectly from your refusal or failure to take physical posession of your property from carrier.
- You represent that you know which part(s) you are ordering
and that you understand how to safely install and operate the
part(s). You represent that you have obtained competent technical
advice regarding the part(s) prior to placing your order with
us.
- Please... don't assume. If you have any questions about am
item, please ask us before you
place your order. A simple question before may save us both a
headache after.
- We prefer payment by U.S.P.S. Money Order, but we will also
accept your check if it is drawn on a U.S. bank and payable in
U.S.
Dollars. We also accept payment via PayPal, and we will also accept payment by cash for in-person pickups. We STRONGLY discourage the sending of cash through the postal system or any other carroer. Payments by methods other than U.S.P.S. Money Order or cash
may result in your shipment being delayed until after the funds
have been finally cleared into our account (NOTE: There is no exception this for bank checks, cashier checks, or non-USPS money orders).
- We want you to be satisfied with your purchase from us and
with the overall process. If you are, please tell your friends,
your neighbors, anyone else you can tell. If you aren't satisfied
for
any reason, please tell us right away so we can work with you
to try to get things squared away as quickly as possible.
